The Thirty-Ninth Regiment Massachusetts Volunteers, 1862-1865

Note D — A RAINY MARCH

Reading edition

Reference to the records of the officers, as given in the archives of Vermont and Massachusetts, shows that Colonel Davis was commissioned August 29, 1862, and Colonel Jewett on the 26th, though the document was not issued until the 30th. Since possession is universally considered nine points of law, it would seem that the burden of evidence was on the side of the Massachusetts Colonel.
