Reading edition

United States ex rel. T.V.A. v. Welch, 327 U.S. 546, 551-552, 556-558 (1946), citing Case v. Bowles, 327 U.S. 92, 101 (1946), and New York v. United States, 326 U.S. 572 (1946)—Concurring in the result, Justice Frankfurter insisted that "the fact that the nature of the subject matter gives the legislative determination nearly immunity from judicial review does not mean that the power to review is wanting." Also concurring in the result, Justice Reed, for himself and Chief Justice Stone, dissented from that portion of the opinion which suggested that "there is no judicial review" of the question whether a "taking is for a public purpose."
