Prostitution in Europe

Note 552 — Chapter IX · ABOLITION AND ORDER

Reading edition

The importance of this factor from a practical point of view is made clear by the following considerations: “Solicitation per se is not an offence.” (Report, Roy. Com., p. 119). “In a prosecution under the Metropolitan Police Act there must be evidence sufficient to satisfy the magistrate that the woman is a prostitute. Next, there must be evidence as to the actions of the woman showing that she was loitering in a thoroughfare or public place for the purpose of prostitution or solicitation; and, lastly, there must be evidence that her action was to the annoyance of the inhabitants or passengers.” Ibid., p. 49.
